This website sets out Fisher & Paykel Healthcare’s approach to complying with the European Union Data Act (Regulation 2023/2584). 

The Data Act, applicable from 12 September 2025, regulates the access and use of certain data generated by connected products and related services.  

Fisher & Paykel Healthcare complies with the Data Act by making certain data available to European Union users of in-scope Fisher & Paykel Healthcare products and platforms, and third parties of their choice, including through this site.

In-scope products and platforms

The following Fisher & Paykel Healthcare products sold into the European Union from 12 September 2025 are considered “connected products” under the Data Act:

  • F&P Airvo™ 3 nasal high flow therapy system;
  • F&P myAirvo™ 3 nasal high flow therapy system; and
  • F&P SleepStyle™ CPAP device.

The following Fisher & Paykel Healthcare platforms are considered “related services” under the Data Act:

  • The F&P InfoSmart™ Web platform, as a related service to the SleepStyle device; and
  • The F&P Healthcare Device Manager application, as a related service to the Airvo 3 and myAirvo 3 nasal high flow therapy systems. 


Types of data and purposes for processing

For each product and platform, you will find details on the estimated volume and frequency of data collection, the data storage arrangements (including retention duration), and the technical means available to access, retrieve or erase the data.

You will also find a description of the purpose for which it is processed by Fisher & Paykel Healthcare.  Such data may be used by Fisher & Paykel Healthcare, its affiliates, and authorized third parties. 


How you can exercise your rights under the Data Act

Fisher & Paykel Healthcare recognises that users of connected products or related services can access and use the data generated by the use of the connected product or related service, including sharing the data with third parties of their choice.  

To make a Data Act request as a user or an authorised third party, please fill in the form set out here.  Data will be made available in a structured, commonly used and machine-readable format, free of charge, unless otherwise agreed.

Data collected from connected products or related services may contain personal data and be subject to the European Union General Data Protection Regulation (GDPR).  You may also have rights under the GDPR.  To find out more, including how to exercise your rights under the GDPR, please see our Global Privacy Statement.

You have a right to lodge a complaint with a competent authority responsible for enforcing the Data Act in your country if you have concerns about how we manage your data or are not satisfied with how we respond to your concerns.  As of 12 September 2025, the designation of such authorities is pending in several EU Member States. Once available, we will update this section to include the relevant contact details. Where the data in question is personal data, you also have the right to lodge a complaint with your local competent data protection authority under the GDPR.
