Email Marketing Policy

Privacy Statement

Fisher & Paykel Healthcare Limited is the Data Controller in respect of personal information (“PI”) collected when you choose to subscribe for receiving email marketing communications from us. You do not have to provide us with your PI, but please note that if you choose not to do so, we may not be able to send you information about our business. The PI collected includes information:

  • which you provide directly to us (for example, your name and email address);
  • indirectly collected from you (see section headed ‘Tracking Technologies’ below); and
  • which may be collected from third party sources (for example, we may collect demographic information and online behavioural data from public data bases or social media platforms).

Based on your consent to the processing of your PI as set out in this Privacy Statement, we will use your PI to send you information about our business (including products and/or clinical developments), to obtain feedback and to perform analytics to operate, evaluate and improve our business.

Your PI will be disclosed to our staff in NZ and to staff of other entities in our group. New Zealand has been recognized by the European Commission as providing an adequate level of data protection. MailChimp™, which is our email marketing platform, will also have access to your PI. MailChimp stores your data on servers located in the United States and is certified to the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. We will retain your PI for as long as you remain subscribed to receive email marketing communications from us.  You may at any time withdraw your consent to the processing of your PI and unsubscribe from our email marketing list. To do so, please let us know by email to info@fphcare.co.nz. We note this will not affect the lawfulness of our previous processing of your PI.

Subject to applicable law, you may also have the right to 1) access your PI, 2) have the PI we hold about you corrected or updated if it is incorrect, incomplete or inaccurate, 3) have your PI deleted or its use restricted, 4) object to the use of your PI and/or 5) receive, in a structured, commonly used and machine-readable format, the PI that you have provided to us, and to transmit this Information to a third party.  If you wish to exercise any of these rights (to the extent applicable), please contact us at privacy@fphcare.com and provide a copy of your valid ID document (valid national ID card, driver’s license or passport) with your request. We will comply with your request as soon as reasonably possible in compliance with applicable law.

If you believe that your privacy or rights have been breached, you have the right to lay a complaint with a privacy regulator. Tracking Technologies

Our marketing emails may utilise tracking technologies such as cookies and web beacons.  Whilst certain tracking technologies (such as cookies) can be rejected or disabled (see below), you may not have the ability to do this for all tracking technologies. If you do not accept the use of tracking technologies, please do not subscribe to receive email marketing communications from us.

A cookie is a small data file that is placed on your computer or mobile device when you visit a website by clicking on a link in our marketing email. The use of cookies is industry standard and most major websites use cookies. If you do not wish to receive a cookie, you can set your browser to notify you when you receive it, and to decline or accept it.  These settings are usually found in the ‘options’ or ‘preferences’ menu of your internet browser. Please note that if you access and click on links in our marketing emails from various browsers or devices, you will have to change your settings on each of these browsers or devices to accept or decline cookies. A web beacon is a small graphic file that gathers information. Emails which we send you may contain web beacons which, when you open the email or click certain links in those emails, collect information such as your IP address, date and time of the open/click.

These technologies are set by MailChimp and/or Google, and provide us with information about how our email campaigns have performed and what actions you, as a subscriber, have taken in response to it.
